Protection for whistleblowers in the workplace

Information on the Implementation of the Whistleblower Protection Act

Initial situation

The Bundestag and Bundesrat have passed the Whistleblower Protection Act (HinSchG). It entered into force on July 2, 2023. The Act transposes the European Union’s Whistleblower Directive into national law.

The purpose of the law is to prevent discrimination against individuals who wish to report violations of applicable requirements (laws, guidelines, or key internal company policies) in a professional context and thereby make an important contribution to uncovering misconduct (compliance violations).

The reporting office must maintain the confidentiality of the whistleblower. In addition to strictly complying with all relevant data protection regulations, Peak Mobility GmbH guarantees that all reports received will be handled confidentially. Anonymous reports are also accepted.

There is no protection for whistleblowers if the disclosure of inaccurate information was intentional or the result of gross negligence.

The whistleblower system should be used responsibly, as accusing someone of wrongdoing can have serious consequences for that person. In the absence of concrete evidence, the presumption of innocence always applies to the person concerned.

An effective whistleblower system serves as an excellent early-warning system for identifying risks within the organization and uncovering vulnerabilities.
